The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 4 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
June 2024 - Code a01706 (appeal dismissed):
- This appeal decision provides an example of where it was concluded that a particular structure (or particular works) should be assessed against Class A (i.e. rather than Class D).
[Note: The works would alter an existing porch (including the replacement of its mono-pitched roof with a shallower mono-pitched roof) and would remove an existing canopy].
[Quote: “The appellant suggests that the alterations to the roof would be constructed in accordance with the planning permission granted by the Town and Country Planning (General Permitted Development) (England) Order 2015 (GPDO), known as ‘permitted development’, specifically Class D, Part 1, Schedule 2 which relates to the erection or construction of a porch outside any external door of a dwellinghouse. However, the proposal would involve alterations to the existing front canopy and porch rather than the erection or construction of a porch. As such, it should be assessed against Class A, which relates to the enlargement, improvement or other alteration of a dwellinghouse.”]. - Class D does not allow the alteration or enlargement of an existing porch (i.e. it only allows the erection of a new porch). June 2024 - Code a01705 (appeal dismissed):
- This appeal decision provides an example of where a property has a (relatively minor) projecting element that the Inspector concluded does form part of “the principal elevation”.
[Note: The projecting element is a structure on the main roof that joins the front and rear parts of the side eaves. The structure has a front-facing roof that’s triangular-shaped with (overall) height approx 1.2m and (overall) width approx 1.2m]. - In the second of the above diagrams, “Roof Extension A” does not comply with B.1(c). [Note: The diagrams are viewable within the “Extend beyond” topic of this document]. (*)
[Note: The recessed front roof does not extend sideways (i.e. all of the recessed front roof is directly to the rear of the side roof of the front projection)].
