“GPDO Part 1 (All Classes) – LDC Appeal Decisions” – 5 additional appeal decisions (total = 1,835) …

The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 5 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

August 2024 - Code a01729 (appeal dismissed):

  • This appeal decision provides an example of where the Inspector (specifically) concluded that an end-of-terrace house does constitute a “terrace house” for the purposes of B.1(d).
[Quote: “I understand that [the application site] forms part of a short terrace of only three properties. Being at the end of that terrace, the dwellinghouse only shares a party wall with one other dwelling, as would be the case with a semi-detached dwelling. However, the adjoining property shares a party wall with the dwellinghouse on either side of it, such that, as a whole the three dwellinghouses form a terrace as defined by the TG. Dwellinghouses which are at the end of a terrace row are clearly included in that definition and rightly have the same permitted development rights as all other dwellinghouses within a terrace. Thus, [the application site] is a terrace house and the proposed extensions would add more than 40 cubic metres of volume to the roof space. The extensions fall to be considered under, but do not comply with, paragraph B.1 (d) of Class B, Part 1, Schedule 2, Article 3 of the GPDO.”].

August 2024 - Code a01728 (appeal dismissed):

  • Where a property has a secondary roof that’s slightly lower than the main roof, then an extension on top of this secondary roof should be assessed against both Class A and Class B. (*)
[Note: The secondary roof is the lower and upper parts of a cat-slide roof on a two-storey house].
[Note: The works involve increasing the height (by approx 2.0m) of the side wall (as well as the corresponding triangular parts of the front and rear walls) of the original one-and-a-half-storey side projection. In addition, the works include the installation of new first floor front and rear windows, which would be situated partly within the existing first floor front and rear walls, as well as partly within the new first floor front and rear walls].
