The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 6 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

October 2024 - Code a01751 (appeal dismissed):

  • This appeal decision provides an example of where the submitted information contained inconsistencies (or similar), and the Inspector concluded that an LDC should be refused on this basis.
    [Note: The Inspector states that “it is not clear from the evidence whether the appellant is proposing to replace all windows or just some of them”, and states that “the existing and proposed plans are submitted at a scale where it is not possible to determine with certainty whether the proposed replacement [UPVC] window frames would have the same profile and dimensions as [the existing timber window frames]”].

October 2024 - Code a01750 (appeal dismissed):

  • This appeal decision provides an example of where it was concluded that a particular piece of land is not within the “curtilage” of the property.
    [Note: The land is approx 67m-87m from the main house and separated from the main house by a [farm] “track” and “boundaries” (note: the latter appears to refer to previous fences that may have subsequently been removed)].
