“GPDO Part 1 (All Classes) – LDC Appeal Decisions” – 6 additional appeal decisions (total = 1,865) …

The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 6 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

December 2024 - Code a01759 (appeal dismissed):

  • This appeal decision provides an example of where the submitted information contained inconsistencies (or similar), and the Inspector concluded that an LDC should be refused on this basis.
[Note: For the single storey extensions and the two-storey extensions, the Inspector states that "No elevation drawings have been submitted to show the exact position of these extensions, their sizes and how they relate to each other or the original dwellinghouse". For the "attic conversion", the Inspector states that "the accompanying drawing ... provides no details regarding any addition to the roof, its size or position". For the outbuildings, the Inspector states that "no information has been provided regarding their design, size and/or layout".].
  • In an application for an LDC, the burden of proof is firmly on the applicant.

November 2024 - Code a01758 (appeal allowed):

  • This appeal decision provides an example of where it was concluded that a particular structure does constitute a “building or enclosure” for the purposes of Class E.
[Note: The structure is a “caravan” with length approx 18.0m, width approx 6.7m, and height approx 2.5m-3.0m].
[Quote: “The appeal involves the siting of a caravan in the rear garden of a dwellinghouse which, by reason of its dimensions, satisfies the definition of a caravan as described in the Caravan Act 1960 and the Control of Development and Caravan Sites Act 1968. The caravan is to serve as an outbuilding for the enjoyment of the dwellinghouse. The appellant indicates that it will be used as a music/study room and store, although it does have w/c facilities. I have not been provided with any information which suggests that the land upon which the development is sited is anything but residential curtilage benefitting [the application site]. As such, it can be considered under the provisions of Class E, Part 1, Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015, as amended. This concerns buildings incidental to the enjoyment of a dwellinghouse. From my site visit it was clear that the outbuilding satisfies the limitations of provisos (a) to (j) of Class E. Also, by the information submitted it does not contain primary residential accommodation which could not be provided for within the dwellinghouse itself. Moreover, it is not proposed to use the outbuilding as a self-contained residential unit. Given the narrative form of the development’s description, as set out on the original application form, I am instead describing the development as the stationing of a caravan to be used as an outbuilding for purposes incidental to the enjoyment of the dwellinghouse. This better targets the development involved, and is consistent with the content of the Design and Access Statement submitted alongside the application. [...] I note the Council, in its Written Statement has decided not to contest the appeal. In the circumstances, and on the basis of my findings which I have set out, I am satisfied that the outbuilding constitutes permitted development.”].
