The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 3 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
December 2024 - Code a01764 (appeal allowed):
- It is possible to issue an LDC for proposed works that would depend on (e.g. be attached to) other works, where the other works have been granted planning permission by the Council but are not substantially complete. [Note: This conclusion assumes that the combined works would not be permitted development]. (*)
[Note: In my opinion, the above conclusion is questionable].
[Note: This appeal decision implies (rather than states) this conclusion].
[Note: The proposed hip-to-gable roof extension would be situated on the side roof of a two-storey side extension that has been granted PP. At the time when the application for an LDC under section 192 (proposed) was submitted, the PP works had been granted PP, (probably) had not been begun, and (almost certainly) had not been substantially completed].
December 2024 - Code a01763 (appeal dismissed):

December 2024 - Code a01762 (appeal dismissed):

Notes:
- To view the conclusions, summaries, and decision notices for any of the above appeals, please view the "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document. As a member of the Planning Jungle website, you can view the decision notices for all of the appeals on the website for no extra cost.
- Any of the above conclusions marked with a "(*)" contradict other appeal decisions. The "Reference Section" within the above document indicates how many appeals have supported and contradicted each particular conclusion.
