The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 1 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
January 2025 - Code a01774 (appeal dismissed):
- This appeal decision provides an example of the types of factors that should be taken into consideration when determining which elevation is “the principal elevation”.
- This appeal decision provides an example of where it was concluded that a particular elevation does not “front” a highway, noting that the elevation and the highway are separated either by a significant distance or by land in different ownership or use. (*)
[Note: Separated by a distance of approx 50m, and separated by an area of land (“several gardens or plots of land”) that appears to be in different ownership]. - This appeal decision provides an example of where it was concluded that a particular structure (or particular works) should be assessed against Class D (i.e. rather than Class A).
[Note: In my opinion, this appeal decision is questionable].
[Note: The structure would be situated outside an existing window (rather than outside an existing external door) on the principal elevation].
[Quote: “I have dealt with this in some detail as it forms the appellant’s main argument. However, it is entirely irrelevant as the development in question is a porch and porches fall under Class D, which I have discussed above. It is not open to an appellant to pick and choose which part of the GPDO to use. Many forms of development are removed from Class A, such as alterations to the roof, garden buildings, hard surfaces and of course porches. These are each considered under a separate class of their own. Class D is labelled “the erection or construction of a porch outside any external door of a dwellinghouse”. It is not open to consider a porch as an extension because Class A is more liberal than Class D. It is clear the development proposed is not permitted development.”].
