The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 4 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
March 2025 - Code a01790 (appeal dismissed):
- This appeal decision provides an example of where it was concluded that a particular piece of land is not within the “curtilage” of the property. (*)
[Note: The land is approx 45m-55m from the main house, and the Inspector states that “at present, access to the site from the house is by way of terraces, steps, pathways alongside the stream and stepping-stones over it”]. - This appeal decision provides an example of the types of factors that should be taken into consideration when determining which elevation is “the principal elevation”.
- E.1(c) not only prevents an outbuilding from being directly in front of the principal elevation, but also prevents an outbuilding from being in front of the imaginary line of the principal elevation when extended to either side.
- This appeal decision provides an example of where it was concluded that a particular structure does not constitute a “verandah, balcony or raised platform”. [Note: In other words, such a structure is not prevented by the limitations about balconies (i.e. A.1(k), B.1(e), and E.1(h))].
[Conclusion: An outbuilding, the base of which is supported on stilts (with height approx 0m-2.3m above the adjacent ground level), is NOT a “raised platform”].
March 2025 - Code a01789 (appeal dismissed):
- The side wall of an original (part-width) rear projection (i.e. the side wall facing the infill area) is “a wall forming a side elevation”. (*)
[Note: The original rear projection is single storey]. - For example, an extension to the side of an original (part-width) rear projection where the extension has a width greater than half the width of the original house is not permitted development. (*)
