The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 2 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
April 2025 - Code a01796 (appeal dismissed):
- This appeal decision provides an example of where the submitted information contained inconsistencies (or similar), and the Inspector concluded that an LDC should be refused on this basis.
[Note: The submitted application form describes the works as “Small 2m x 2.3m extension which will end in line with terraced neighbours property”. However, the Inspector states that “No existing or proposed floor plans or elevations have been submitted”, and states that “Although the grounds for the application further explain that the extension would be single storey, height dimensions are not provided”.]. - This appeal decision provides an example of where it was concluded that a particular structure is “original”.
[Note: Relates to A.1(f) and A.1(j) of the GPDO 2015].
[Note: The structure is a (part-width) single storey rear projection].
[Quote: “The appellant explains that since receiving the decision notice, he has removed a brick from the rear of the house and compared it to one from the front of the property. Again, I’m left to assume the brick from the rear of the property has come from the single storey projection, rather than the main two storey building. Pictures of two bricks are provided, both of which are stamped with the manufactures name. Although not revealed in full, it is likely that the manufacturers name stamped on both is ‘The Metropolitan Brick and Tile Co.’ from Irthlingborough. Historical information provided indicates that manufacturer probably did not survive beyond 1910. Therefore, on the basis that the brick taken from the rear of the property is from the single storey part, it is more likely than not, that the ‘original dwellinghouse’, as it existed on 1 July 1948, included that rear projection. That position is reinforced by the existence of similar rear projections at the neighbouring properties, particularly [the neighbouring property to the east], which is built on the same building line and has what appears to be a matching rear projection, reflecting that shown on the Land Registry Title Plan.”].
