The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 5 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

May 2025 - Code a01804 (appeal allowed):

• This appeal decision provides an example of where it was concluded that a particular piece of land is within the “curtilage” of the property.
  [Note: The land is approx 0m-15m from the main house and partly separated from the main house by a wall].
• This appeal decision states, or implies, that it is possible for an application under section 192 (proposed) to ask the (general) question of whether a property benefits from Part 1 of the GPDO (i.e. without specifying a particular set of works). (*)
  [Note: The Inspector issues an LDC for “Confirmation that all of the extent of the land forming the property known as [the application site] is residential curtilage and therefore enjoys householder permitted development rights”].
  [Quote: “It is important that I emphasise, however, that in confirming that householder permitted development rights are applicable in so far that the whole of the land is residential curtilage, the appellant must still separately check (or if necessary seek separate confirmation as part of a different LDC application) that any proposed development meets the limitations, restrictions and/or conditions that might be imposed in respect of any relevant class of development in the GPDO.”].

April 2025 - Code a01803 (appeal allowed):

• This appeal decision provides an example of where it was concluded that a particular piece of land is within the “curtilage” of the property.
