“GPDO Part 1 (All Classes) – LDC Appeal Decisions” – 4 additional appeal decisions (total = 1,914) …

The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 4 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:

May 2025 - Code a01808 (appeal dismissed):

  • The phrase “the highest part of the ... roof” relates to the property as a whole (i.e. not only to the part of the property that’s being altered or enlarged). (*)
  • For example, where a property has a secondary roof that’s lower than the main roof, then an extension on top of this secondary roof can be higher than the highest part of this secondary roof (i.e. so long as the extension is not higher than the highest part of the main roof). (*)
[Note: The proposed flat roof of the extension is higher than the existing flat roof of the extension].
  • This appeal decision provides an example of where it was concluded that the following materials are not “of a similar appearance” to one-another:
    - sedum versus corrugated asbestos sheets.
[Note: On the proposed roof of a single storey side extension versus on the existing roof of a single storey side extension (respectively)].
  • This appeal decision provides an example of where it was concluded that the following materials are not “of a similar appearance” to one-another:
    - sedum versus grey slates.
[Note: On the roof of a single storey side extension versus on the main house (respectively)].

May 2025 - Code a01807 (appeal allowed):

  • E.3 only prevents an outbuilding from being within the area that’s directly in between the side wall of the house and the side boundary. [Note: In other words, E.3 does not prevent an outbuilding from being within the additional area that can be covered if considering the imaginary line of the side wall when extended forward and rearward].
