The "GPDO Part 1 (All Classes) - LDC Appeal Decisions" document has been updated to include 4 additional appeal decisions relating to householder permitted development legislation, for which the conclusions are as follows:
August 2025 - Code a01834 (appeal dismissed):
- This appeal decision provides an example of where it was concluded that a particular piece of land is not within the “curtilage” of the property.
[Note: The land is approx 110m-133m from the main house and within a “wooded area”]. - Furthermore, the above was concluded even though it was accepted that the piece of land is within the same ownership / unit of occupation / planning unit as the main house.
[Quote: “It seems the unit of occupation is the appellant’s landholding and so the planning unit is likely to comprise the entire site, as shown on the Land Registry Title Plan. However, the planning unit and curtilage are not necessarily the same and I note that the appellant does not suggest that the whole of the land within their ownership is within the curtilage of the dwellinghouse.”]. - The “curtilage” of a dwellinghouse can change over time (e.g. it can become larger, smaller, etc).
[Quote: “It is therefore not clear from the statement provided whether the location of the appeal building comprised curtilage in the 1980’s. Nevertheless, curtilage can change over time.”].
