The "GPDO Part 1 Class E (Incidental Requirement) - LDC Appeal Decisions" document has been updated to include 5 additional appeal decisions relating to the "incidental" requirement of Part 1 Class E, for which the conclusions (short version) are as follows:
December 2025 - Code b00625:
- Outbuilding (total area 66m2) containing gym / office (37m2), shed (12m2), and shower room (with WC) (2m2).
- Conclusion: NOT incidental
December 2025 - Code b00624:
- Outbuilding (total area 36m2) containing playroom (11m2), gym (11m2), and shower room (with WC) (4m2).
- Conclusion: INCIDENTAL
December 2025 - Code b00623:
- Outbuilding 1 (total area 49m2) containing garden store (40m2).
- Outbuilding 2 (total area 64m2) containing gym (27m2), home office (18m2), store (2m2) and WC (2m2).
- Outbuilding 3 (total area 120m2) containing swimming pool (95m2), changing room + shower room + WC (7m2), and plant room (6m2).
- Note: When assessing the structure against the "incidental" requirement of Part 1 Class E, the Inspector states that "The three proposed outbuildings must be considered individually rather than collectively".
- Conclusion: INCIDENTAL
December 2025 - Code b00622:
- Outbuilding (total area 48m2) for which the submitted drawings show a gym (36m2) and bathroom (4m2), but which the submitted application form describes as "Gym/ Playroom and storage area".
- Conclusion: NOT incidental
December 2025 - Code b00621:
- Outbuilding (total area 240m2) containing swimming pool (198m2), changing room + shower room + WC (14m2), and plant room (6m2).
- Conclusion: INCIDENTAL
