New Legislation – relating to the DMPO 2015 (26/03/2026) …

The following 1 new Statutory Instrument (SI) comes into force on 26/03/2026:

New Legislation:

  • March 2026: SI 2026 No. 215 - The Town and Country Planning (Development Management Procedure) (England) (Amendment and Transitional Provision) Order 2026 (pdf) (link).
  • UPDATE: April 2026: SI 2026 No. 215 - Correction (pdf) (link).

Notes:

  • The above SI 2026 No. 215 makes an amendment to the following SI:
    - DMPO 2015.
  • Note: The "Explanatory Memorandum" (link) to the above SI 2026 No. 215 includes the following information:
    - "Article 18(5) of the [DMPO 2015] provides that, where a local planning authority is required to consult by or under article 18 (including by a direction under article 18(4)) or article 20 before granting planning permission, they (a) must give notice of the application to the consultee and (b) must not determine the application until at least 21 days (18 in the case of public service infrastructure development) have elapsed, (or all consultees have responded or given notice that they do not intend to respond).".
    - "The Ministry has identified that article 18(5) of the [DMPO 2015] would not apply in a case where an article 18(4) direction only requires consultation before refusal of planning permission. Article 2 of this Order [SI 2026 No. 215] therefore amends article 18(5) [of the DMPO 2015] so that it applies to any requirement to consult before determining a planning application (whether by way of grant or refusal).".
    - "Article 3 [of SI 2026 No. 215] makes transitional provision. The amended provision does not apply to applications for planning permission which have been submitted to a local planning authority, but not determined, before the commencement of this Order [SI 2026 No. 215] if the relevant article 18(4) direction was in force before the commencement of this Order [SI 2026 No. 215]. This ensures that existing applications subject to existing consultation and safeguarding directions made under article 18(4) [of the DMPO 2015] are not affected by the change.".
