Section 6(10) of the following Act comes into force on 24/07/2026:

Note: Although the above Act was granted Royal Assent on 18/12/2025, section 6(10) of the above Act is brought into force on 24/07/2026 by SI 2026 No. 641 (C. 52) (link).

Notes:

  • Section 6(10) of the above Act makes consequential amendments to the following SI:
    - The Infrastructure Planning (Environmental Impact Assessment) Regulations
    2017.
  • Note: The "Explanatory Notes" (pdf) (link) for the Planning and Infrastructure Act 2025 include the following information:
    - "[Section 6] makes several changes to the Planning Act 2008 as a consequence of section 5 and the removal of statutory pre-application consultation requirements. This section removes references to statutory requirements for consultation in other sections of the Planning Act 2008, as well as the requirements for associated documentation (such as the consultation report) and amends the provisions about requirements.".

    - "Subsection (10) [of section 6] removes the requirement for the applicants to consult on preliminary environmental information and any references in the Infrastructure Planning (Environmental Impact Assessment) Regulations to omitted sections under section 4.".
