The following document has recently appeared on the Planning Portal website:

  • Advice produced by the Planning Inspectorate for use by its Inspectors - 15 January 2014 - Houses in Multiple Occupation (HMOs) and Permitted Development Rights (pdf).

UPDATE: The above document appeared on the Planning Portal website in January 2014 (and was available via this link), but was subsequently removed in 2015-2016. As such, it's difficult to know what weight should now be given to the above document. Continue reading

Introduction:

Since the “Permitted Development for Householders – Technical Guidance” document was updated in October 2013, the Department for Communities and Local Government (DCLG) has made further updates to this document on (at least) two separate occasions, but without changing the date of this document. This means that there are now three separate versions of the “Technical Guidance” document dated "October 2013". The following new Statutory Instrument has been incorporated into the GPDO 1995 (Consolidated) document:

  • May 2013: SI 2013 No. 1101 - The Town and Country Planning (General Permitted Development) (Amendment) (England) Order 2013 (pdf) (link).
