Notes about the above additional document:

  • The above document was written on 03/03/2012, and was emailed to the Department for Communities and Local Government (DCLG) on 04/03/2012.
  • The above document does not comment on the principle of the CIL Regulations 2010; instead it comments on the significant problems that are likely to arise due to the specific design of the formulae for CIL. Please note that the above document comments on the formulae for CIL that existed on 03/03/2012 (as set out by regulations 40 and 50 of SI 2010 No. 948, incorporating the amendments by SI 2011 No. 987).
  • In the 3 years since the above document was emailed to DCLG, they have still not resolved any of the significant flaws that were highlighted by the above document. For reference, the above document stated that "the current formulae for CIL .. are based upon a very unsound foundation that no amount of adjustments, quick fixes, additional definitions, etc, is likely to be able to correct". This statement is now supported by the fact that the subsequent adjustments to the formulae by SI 2012 No. 2975 and SI 2014 No. 385 have still not resolved any of the significant flaws that were highlighted by the above document, and instead have made the formulae even more unnecessarily complicated.
